Stanford had in law committed the offence with which he was charged, but that no doubt the Judge would reduce the punishment to at most six months imprisonment on the ground of extenuating circumstances if all view of defence was abandoned and that the course so recommended was adopted.
That on the behalf of the said Rustomjee, the said William Kent Stanford was called by the prosecution to give evidence to the effect stated and that Rustomjee was the real delinquent, and that there was no attempt on the part of Rustomjee's Advocate to shew by Cross-examination or otherwise that such evidence was in any way untrue or inaccurate.
That Your Memorialist was informed that after her said Husband had given such Evidence and thereby to a great degree exculpated himself from Guilt, it was certain that his sentence would be remitted either partially or entirely and that she has remained now for nearly three years unceasingly in a state of the most anxious and troubled suspense to the great injury of her health and destruction of her happiness.
That the said William Kent Stanford has during the time of his imprisonment made himself most useful and has for some time acted as Assistant to the Surgeon in his place of confinement.
Your Memorialist would therefore most humbly but most earnestly pray that you would be pleased to take her desolate state into consideration on the grounds of the excessive severity of the sentence, of her Husband having proved himself to a great degree innocent, and of the very heavy amount of punishment already suffered, and would be pleased to order that the unexpired residue of the sentence may be remitted and her husband restored to her. Your Memorialist's marriage only took place a few months before this calamity occurred.
